Welcome to Imagery Dance (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the website www.imagery.dance (the “Site”), including any purchases, registrations, bookings, or services offered through the Site.
By accessing this website, registering for classes, or purchasing products, you agree to be bound by these Terms. If you do not agree, please do not use the website.
These Terms should be read alongside our Privacy Policy and, for class participants, the separate Class Participation Waiver.
1. Services & Products Offered
Imagery Dance offers:
- In-person and/or virtual dance and movement classes
- Educational and experiential content related to imagery-based movement practices
- Digital products, including ebooks and downloadable materials
- Physical products, including printed books produced using print-on-demand technology
Future offerings may include online courses, recorded classes, workshops, class packages, subscriptions, or other digital content. These Terms apply to all current and future offerings unless supplementary terms are provided at the point of purchase.
All offerings are subject to availability and may change at any time without prior notice.
2. Eligibility
By using this website or registering for a class, you confirm that:
- You are at least 18 years old; or
- You are under 18 and your parent or legal guardian has reviewed and accepted these Terms on your behalf and will supervise your use of the Site and participation in any classes.
Registration for participants under 13 must be completed by a parent or legal guardian in compliance with the Children’s Online Privacy Protection Act (COPPA).
You are responsible for ensuring that participation in any class or program is appropriate for your physical and mental condition. We recommend consulting a qualified healthcare provider before beginning any new movement or exercise program.
3. Class Registration & Participation
Registration
- Registration is completed upon successful payment and acceptance of the Class Participation Waiver.
- Space in classes may be limited and is not guaranteed until payment is received and confirmed.
Attendance & Responsibility
- Participation is voluntary and at your own risk.
- You agree to listen to your body, modify movements as needed, and stop if you experience pain, dizziness, discomfort, or any other concerning symptoms.
- You are solely responsible for determining whether your physical condition permits safe participation.
- Please disclose any known physical limitations, injuries, or pre-existing conditions to the instructor before participating.
Virtual Classes
If participating in a class remotely, you are solely responsible for ensuring a safe environment, including adequate clear space, appropriate flooring, and removal of potential hazards. You acknowledge that the instructor’s ability to observe and correct your movements is limited in a virtual setting.
Cancellations & Schedule Changes
- Specific cancellation policies will be stated at the time of booking.
- We reserve the right to cancel, reschedule, or modify classes due to insufficient enrollment, instructor unavailability, weather, or other circumstances beyond our control. If we cancel a class, you will receive a full credit or refund.
4. Payments & Pricing
- All prices are listed in US Dollars (USD) unless otherwise stated.
- Payment is due at the time of booking or purchase.
- Payments are processed securely through Stripe and/or PayPal. Your payment information is encrypted and handled in accordance with Payment Card Industry Data Security Standards (PCI-DSS). We do not store your full credit card details on our servers.
- We reserve the right to change pricing at any time. Price changes will not affect orders or bookings already confirmed.
- You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.
5. Refunds, Returns & Cancellations
We want you to be satisfied with your purchase. If you have any concerns, please contact us at contact@imagery.dance before initiating a dispute with your payment provider.
Dance Classes
- Refund and cancellation policies will be stated at the time of booking.
- Missed classes are generally non-refundable unless otherwise specified.
- Class packages or credits, if offered, will have expiration dates clearly stated at the time of purchase.
Digital Products (Ebooks & Downloads)
- Due to the nature of digital products, all digital sales are final once the product has been accessed or downloaded.
- If you experience a technical issue that prevents you from accessing your purchase, please contact us within 7 days of purchase and we will work to resolve the issue or provide a replacement.
- For customers in the EU/EEA or UK: By completing your purchase of digital content, you expressly consent to immediate delivery and acknowledge that you waive your statutory right of withdrawal once the content has been accessed or downloaded. Nothing in these Terms affects your statutory rights under the laws of your country of residence.
Physical Products (Printed Books)
- Our physical books are produced using print-on-demand technology. Each book is printed individually after your order is placed. Please allow 5–15 business days for production before shipping.
- If your book arrives damaged or with manufacturing defects (such as printing errors, missing pages, binding failures, or shipping damage), contact us within 14 days of delivery with your order number, a description of the issue, and photographs. We will arrange a replacement or full refund at no additional cost to you.
- Due to the made-to-order nature of our books, we cannot accept returns for change of mind, except where required by applicable local consumer protection law (see Section 15, International Customers).
- Minor variations inherent in digital printing, such as slight color differences between screen and print, do not constitute defects.
6. Shipping & Delivery
Physical Products
- Shipping times and costs vary by destination and will be displayed at checkout.
- We are not responsible for delays caused by shipping carriers, customs processing, or events beyond our control.
- Risk of loss passes to you upon delivery to the carrier. If a package is lost or damaged in transit, please contact us and we will work with the fulfillment provider to resolve the issue.
Digital Products
- Digital products are delivered electronically. Download links or access instructions will be provided immediately upon successful payment.
- You are responsible for ensuring your device meets any technical requirements needed to access the content.
7. Digital Product License & Usage
When you purchase a digital product from Imagery Dance, you receive a limited, non-exclusive, non-transferable, revocable license to access and use the content for your personal, non-commercial use. You do not acquire ownership of the content itself.
You may not:
- Copy, reproduce, distribute, or resell any digital content
- Share download links, login credentials, or access with others
- Modify, adapt, or create derivative works from the content
- Use the content for commercial purposes without written authorization
- Remove any copyright notices or proprietary markings
We reserve the right to revoke your license and terminate access if you violate these terms.
8. Educational Disclaimer — Not Medical Advice
All content, classes, and materials provided by Imagery Dance are for educational and experiential purposes only.
They do not constitute medical advice, therapy, diagnosis, or treatment, and are not a substitute for professional medical, psychological, or therapeutic care.
You agree to consult a qualified healthcare provider regarding any medical or mental health concerns before, during, or after participating in any classes or using any content.
Imagery Dance makes no representations or warranties regarding the health benefits of any class, product, or content.
9. Intellectual Property
All content on this website — including text, images, videos, audio, class materials, choreography, recordings, course content, and written works — is the intellectual property of Imagery Dance or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not:
- Copy, reproduce, distribute, or resell any content
- Record, photograph, or screenshot classes or course materials without written permission
- Use any content for commercial purposes without prior written authorization
- Frame, mirror, or scrape any portion of the Site
Limited personal, non-commercial use is permitted only where explicitly stated.
10. User Conduct
You agree not to:
- Use the website for any unlawful purpose
- Attempt to gain unauthorized access to restricted areas, accounts, or systems
- Share false, misleading, or harmful information
- Disrupt classes, online sessions, or community spaces
- Harass, threaten, or intimidate other participants, instructors, or staff
- Upload or transmit viruses, malware, or other harmful code
We reserve the right to refuse service, remove access, or terminate accounts at our sole discretion, without refund, for violations of these Terms.
11. Third-Party Services
This website uses third-party services for payment processing (Stripe, PayPal), book fulfillment (BookVault), hosting, and other operational functions. These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices, policies, availability, or performance of any third-party service.
Links to third-party websites may be provided for convenience. We do not endorse or assume responsibility for the content, products, or services of any linked third-party site.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMAGERY DANCE, ITS OWNERS, INSTRUCTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE, PARTICIPATION IN CLASSES, OR PURCHASE OR USE OF PRODUCTS, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.
These limitations apply to the fullest extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by gross negligence or willful misconduct, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Imagery Dance, its owners, instructors, employees, and agents from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising from or related to:
- Your use of the website
- Your participation in classes or use of products
- Your violation of these Terms
- Your violation of any applicable law or the rights of any third party
This indemnification obligation applies to the extent permitted by the laws of your jurisdiction. In jurisdictions where indemnification clauses are restricted or unenforceable, this section shall apply to the maximum extent allowed by law.
14. Dispute Resolution
If a dispute arises between you and Imagery Dance, we encourage you to contact us first at contact@imagery.dance so we can attempt to resolve the matter informally. We will make good-faith efforts to resolve any dispute within 30 days of receiving your written notice.
If the dispute cannot be resolved informally, both parties agree to submit the matter to mediation administered by a mutually agreed-upon mediator in the Commonwealth of Pennsylvania before pursuing any other form of dispute resolution.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or prevent irreparable harm.
For customers in the European Union: You may also be entitled to submit a dispute to the Online Dispute Resolution (ODR) platform provided by the European Commission at https://ec.europa.eu/consumers/odr.
15. International Customers
Imagery Dance welcomes customers worldwide. If you are purchasing from outside the United States, please note the following:
General
- These Terms are governed by the laws of the Commonwealth of Pennsylvania, but nothing in these Terms is intended to limit or exclude any mandatory consumer protection rights granted to you under the laws of your country of residence that cannot be waived or limited by contract.
- Where any provision of these Terms conflicts with mandatory local consumer protection laws applicable to you, those local laws shall prevail to the extent of the conflict.
European Union, European Economic Area & United Kingdom
- You have a 14-day right of withdrawal for physical goods purchased at a distance, beginning from the day you receive the product. To exercise this right, contact us at contact@imagery.dance with your order details. You must return the product at your own expense, and we will issue a refund within 14 days of receiving the returned item or proof of return shipment.
- For digital content, the right of withdrawal is waived upon access or download as described in Section 5, provided you gave prior express consent and acknowledged the loss of your withdrawal right before completing the purchase.
- Products must conform to any pre-contractual descriptions provided and be of satisfactory quality. If a product is faulty or not as described, you are entitled to a repair, replacement, or refund in accordance with the Consumer Rights Directive (EU) or the Consumer Rights Act 2015 (UK).
- Nothing in these Terms affects your statutory rights as a consumer under EU or UK law.
Australia & New Zealand
- Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law or the New Zealand Consumer Guarantees Act 1993. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if goods fail to be of acceptable quality and the failure does not amount to a major failure.
- Nothing in these Terms is intended to override or exclude the consumer guarantees provided under Australian or New Zealand law.
Canada
- Canadian consumers may have additional rights under federal and provincial consumer protection legislation, including rights related to distance sales, refunds, and contract cancellation. Nothing in these Terms is intended to limit those rights where they cannot be waived by contract.
Currency, Taxes & Duties
- All prices are displayed in USD. You may be subject to currency conversion fees charged by your payment provider.
- Import duties, customs charges, value-added tax (VAT), goods and services tax (GST), or other local taxes imposed by your country are your responsibility and are not included in our prices.
- International shipping times vary by destination. Estimated delivery windows will be displayed at checkout.
16. Force Majeure
Imagery Dance shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to: natural disasters, pandemics or public health emergencies, government orders or restrictions, severe weather, power outages, internet or telecommunications failures, supply chain disruptions, labor disputes, or acts of terrorism. In such events, affected obligations will be suspended for the duration of the force majeure event, and we will make reasonable efforts to notify affected customers and provide credits or refunds where appropriate.
17. Changes to These Terms
We may update these Terms & Conditions at any time. When we make material changes, we will update the “Effective Date” at the top of this page and, where practicable, notify registered users by email at least 30 days before changes take effect.
Your continued use of the Site after the updated effective date constitutes your acceptance of the revised Terms. Changes will not apply retroactively to orders or bookings already confirmed. If you do not agree to the revised Terms, please discontinue use of the Site.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, Class Participation Waiver (where applicable), and any supplementary terms presented at the point of purchase or registration, constitute the entire agreement between you and Imagery Dance regarding your use of the Site and supersede all prior or contemporaneous communications and proposals.
20. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
Any legal proceedings arising from these Terms shall be brought exclusively in the state or federal courts located in the Commonwealth of Pennsylvania, and you consent to the personal jurisdiction of such courts.
Notwithstanding the foregoing, if you are a consumer resident in a jurisdiction where mandatory local laws grant you the right to bring proceedings in your local courts, nothing in this section shall limit that right.
